Terms and Conditions

Please read these terms and conditions before booking your stay. If you have any questions about them please do not hesitate to contact us.

Sandbanks Holidays (or “we”/”us”) is the owner (“the Owner”) of the property (meaning the holiday apartment). Once the holiday confirmation is issued, this contract is between you (“the Occupier” or “you”), and the Owner.

Terms & Conditions concerning Sandbanks Holiday, Sandbanks Road, Poole, Dorset. BH14 8EJ.

1. Contract
The Contract for a short-term holiday rental shall be made between the Client and Sandbanks Holiday. The Contract shall be governed by UK Law but does not create a Landlord and Tenant relationship under the conditions of the Rent Act. This contract will be entered into when the deposit is processed and Sandbanks Holiday issues the confirmation. The Contract will be subject to all the following booking conditions.

2. Booking
A provisional booking can be made using the online calendar. If you don’t have access to the internet or would prefer to discuss your holiday preferences, please call us on 07966 197 634 or email bookings@sandbanksholiday.co.uk. We reserve the right to refuse any booking without explanation.

3. Payment
A non-refundable booking deposit of 50% of the cost of the holiday must be paid within 24 hours of making your provisional booking once Sandbanks Holiday have accepted your booking enquiry via email. The booking is only confirmed after the deposit is received and a Booking Confirmation email sent from Sandbanks Holiday to the Occupier. You should read the confirmation details carefully and contact Sandbanks Holiday immediately if anything is incorrect. The rental balance is to be paid in full within 4 weeks (28 days) prior to commencement of your stay along with a damage/unreasonable wear and tear deposit of 50% of the total cost of your stay which is refundable within 5 days of the end of your stay less any reasonable costs for breakages, damage etc. If the full balance is not received within 4 weeks prior to the commencement of stay, Sandbanks Holiday reserve the right to cancel the booking and forfeit the deposit paid. For bookings made less than four weeks before the commencement of the rental, the total rental fee is payable on booking. Cheques are accepted and should be made payable to Mr & Mrs Diffey. Cleared funds are required. Bank details for BACS transfer are available on request.

4. Cancellations
Any cancellation must be made in writing, with proof of receipt. Sandbanks Holiday will seek to re-let the property for the period of the booking, and if successful the Occupier’s payment will be refunded minus a £50 administration fee. If the booking is cancelled before 28 days of the arrival date, the 50% deposit will be retained in full and forfeited. Cancellations made 14 days before the arrival date: 50% of the rental fee will be refunded. Cancellations made less than 14 days before arrival date: Full cost of the rental withheld. In the event that following a cancellation, Sandbanks Holidays is able to re-let the accommodation for the period booked (or part of it) 50% of the re-let income will be refunded to the Client. In the unlikely event of cancellation of the reservation due to unavailability of the accommodation, Sandbanks Holiday will provide a full refund of the payment including any deposit paid. The Owner reserves the right to refuse any booking or to cancel any bookings already made subject to refunding any sums you have already paid, except where otherwise stated in clause 3. The Occupier will have no further claim against the Owner. You are advised to arrange a comprehensive travel insurance policy to include cancellation cover and also cover for personal belongings and public liability as these are not covered by the owners insurance.

5. Liability
Sandbanks Holiday does not accept any responsibility for the client’s belongings on the premises of the property and it is the responsibility of the client to arrange appropriate insurance cover.

6. Check In/Check Out
Check In is at 3pm, Check Out is at 10am. The Occupier must abide by the arrival and departure times provided by Sandbanks Holiday.

7. Period of Hire
Rentals commence, unless otherwise arranged with Sandbanks Holiday, at 3pm on the day of arrival and terminate at 10am on the day of departure. Any departure after this time, unless previously agreed, will incur a late departure surcharge of £45. An extra charge of £25 will be payable for abortive appointments, due to the Occupier failing to honour the agreed time.

8. What’s included:
Electricity and gas and an end of holiday cleaning service are included in the rent. Bed linen and towels are provided for the number of people expected at the property but the Occupier should bring their own beach towels. If use of a travel cot has been agreed and paid for, the mattress and all baby bedding and linen should be brought by the Occupier. 

9. Number of persons in the property
The Occupier is the person named on the booking form, and he/she is responsible for the obligations and conditions of hire. The Occupier shall not pass the booking to another party and shall be in residence at the property during the whole of the letting period. The Occupier must notify Sandbanks Holiday of any changes to the number of people staying at the property in writing before the booking starts and must not exceed the maximum number stipulated in the agreement. Sandbanks Holiday reserves the right to refuse entry to the entire party if this condition is not observed.

10. Complaints
We hope your holiday runs smoothly but if you do have a complaint it is essential that you report it immediately so that Sandbanks Holiday can do their best to resolve it. We cannot accept claims for compensation lodged after departure as it is no longer possible to investigate the problem and take remedial action. Compensation will also not be given where the guest has denied the Agent/Owner the opportunity to try to put matters right during a stay. Sandbanks Holidays shall not be held liable for any sudden invasion of pests, building work noise or disruption coming from neighbouring properties or breakdown of appliances, although any breakdowns will be fixed as soon as reasonably possible. Under no circumstances will Sandbanks Holidays’ liability exceed the rental paid for the property.

11. Care of the property
The Occupier shall take all reasonable and proper care of the property and its furniture, pictures, fittings and effects in or on the property and leave them in the same state of repair and in the same clean and tidy condition at the end of the rental period as at the beginning. The Occupier shall not be permitted to move any furniture within the property. The Occupier shall not carry out any activity on the premises which causes a nuisance or annoyance to the owner or adjoining properties, including the playing of musical instruments or stereos at an excessive level between 11pm and 7am.

12. Cleaning and Damage
The Occupier must agree to take good care of the property and its contents and on departure leave it in a clean and tidy condition. The good housekeeping deposit will be returned to the Occupier 5 days after the end of the stay provided that the property has been left in a satisfactory condition. The sum is held to cover any losses, damage and additional cleaning charges that may arise if the property is left in an unsatisfactory condition however caused, but excluding reasonable wear and tear. The Occupier may not be charged for minor items but is responsible for all breakages and damages and the cost will be payable on demand. All damage, loss or breakage to the property or contents must be reported to the Owner as soon as possible. The Owner will repair the damage as soon as is practical. Lost property will be kept for two weeks and if unclaimed it will be donated to local charity shops.  A fee of £10 is payable by cheque to the cleaner to arrange postage and packing. We can not accept any liability for items left at the property.

13. Use of the Property
Sandbanks Holiday regrets that our property is strictly non-smoking and we do not accept pets. A penalty charge of £250 will be made to your security deposit if evidence of smoking or pets is found in the property.
Stag or hen party groups and unaccompanied teenagers are not permitted at the property.
All children staying at the property must be accompanied by their parents or legal guardians at all times.
The property is strictly non-smoking.
The above conditions must be adhered to at all times.
Sandbanks Holiday reserves the right to terminate the Occupier’s stay if they or members of their party display unreasonable behaviour, cause nuisance to other parties or damage to the property, or if the number of persons occupying the property exceeds the maximum stated. The contract is personal to the Occupier. The property shall not be used for any commercial purposes. This booking is granted by Sandbanks Holiday to the Occupier for the Holiday Period and is not intended to create the relationship of Landlord and Tenant between the parties. The Occupier is granted the right to occupy the property for the holiday period specified but the Occupier has no right to remain in the accommodation after this time and shall not be entitled to any statutory security of tenure. In any of the circumstances in this clause no refunds will be made and you will have no further claim against the Owner.
It is not permitted to park caravans or pitch tents within the grounds of the property. 
There is one allocated parking space at the property which is clearly labelled. It is advised to turn left when exiting the property onto the main road.

14. Access to the property
Sandbanks Holiday shall be allowed the right of entry to the property at all reasonable times for purposes of inspection or to carry out any necessary repairs or maintenance.

15. Circumstances beyond the control of the Owner
Except where otherwise stated in these Conditions, Sandbanks Holidays shall not be liable for any change or cancellation which is a result of unusual and unforeseeable circumstances beyond its control; for example fire, flood, exceptional weather conditions and epidemics.

END OF TERMS AND CONDITIONS OF YOUR BOOKING
